General Terms and Conditions

  1. Scope

For the business relationship between Woolly Mallow and the consumer (=customer), the following General Terms and Conditions in their current version at the time of ordering apply exclusively.

  1. Conclusion of Contract, Instruction on Right of Withdrawal and Return

2.1 Conclusion of Contract

The offers made by Woolly Mallow in the online shop are non-binding.

By placing an order in the online shop, the customer makes a binding offer to purchase the respective product. Woolly Mallow can accept the offer until the end of the third working day following the day of the offer.

Woolly Mallow will promptly send the customer a confirmation of receipt of the offer upon receipt of the offer, which does not constitute acceptance of the offer. The offer is only deemed accepted by us once we declare acceptance to the customer (by email) or dispatch the goods. The purchase contract with the customer is only concluded upon our acceptance.

2.2 Instruction on Right of Withdrawal and Return and its Legal Consequences

The customer can revoke his contractual declaration within 14 days without giving reasons in text form (e.g., by letter, fax, email), or if the goods are handed over to him before the deadline, by returning the goods.

The period for the right of withdrawal or return begins upon receipt of this instruction in text form, but not before the goods have been received by the customer and not before the fulfillment of the information obligations in accordance with § 246 para. 2 of the German Civil Code (BGB) in conjunction with § 1 para. 1 and 1 German Introductory Act to the Civil Code (EGBGB).

To comply with the deadline, it is sufficient to send the withdrawal or the goods or the request for return in good time.

In the event of an effective withdrawal or return, the services received by both parties must be returned and any benefits received (e.g., benefits of use, interest) must be surrendered. If the customer is unable to return the goods received in whole or in part or only in a deteriorated condition, he must pay compensation to that extent. This does not apply if the deterioration of the goods is exclusively attributable to their inspection - as would have been possible for the customer in a retail store. Furthermore, the customer can avoid the obligation to provide compensation for any deterioration caused by the intended use of the goods by not using the goods as if they were his own property and by refraining from doing anything that could impair their value.

Goods suitable for parcel shipment must be returned at the expense and risk of Woolly Mallow.

Obligations to reimburse payments must be fulfilled within 30 days. The period begins for the customer with the dispatch of the declaration of withdrawal or the item, for Woolly Mallow with its receipt.

2.3 Exclusion of the Right of Withdrawal and Return

The right of withdrawal does not apply to contracts for the delivery of goods that are made to customer specifications or that are clearly tailored to personal needs, such as the desired attachment of initials to capes or other garments.

  1. Delivery

Unless otherwise agreed, delivery is made from Woolly Mallow warehouse to the delivery address specified by the customer.

If, after the conclusion of the contract (see § 2), Woolly Mallow is unable to deliver the ordered goods without being at fault, for example because the supplier of woolly mallow fails to fulfill its contractual obligations, Woolly Mallow is entitled to withdraw from the contract. In this case, the customer will be promptly informed that the ordered product is not available. The statutory rights of the customer remain unaffected. If delivery to the customer is not possible, for example because the customer is not found at the address provided by him, the customer bears the costs of the unsuccessful delivery.

4.1 Prices

The prices stated on the website at the time of ordering apply.

4.2 Shipping Costs

The shipping costs charged to the customer vary for deliveries within Germany and for deliveries abroad. The current shipping costs can be found on the website.

4.3 Payment Method

The payment method is specified on the website.

  1. Setoff, Retention

A right to setoff is only available to a party if its counterclaims have been legally established, are undisputed, or have been acknowledged in writing by the other party. Furthermore, the party is only entitled to exercise a right of retention insofar as its counterclaim is based on the same contractual relationship.

  1. Retention of Title

The delivered goods remain the property of Woolly Mallow until full payment has been made. The customer is only authorized to dispose of the goods before full payment with the express consent of Woolly Mallow. If the customer is in default with payment of the purchase price, Woolly Mallow is entitled to withdraw from the contract
